The Tenancy Agreement : A legal contract has to be written and signed between owner (landlord) and tenant. Get a E-Stamp paper (e stamp) from nearby sub-registrar office. e-Stamp paper should be worth 100/- and mention the agreement amount on the stamp paper. Print all the terms and conditions of the agreement in the stamp paper. Usually sub registrar will give only One paper of e-Stamp, but you cannot fill all the content of the agreement in one paper. So buy a Two Rupees stamp paper and fill the remaining content in this paper. You can get a Sample Rental Agreement Copy here. Once all the content is filled, your agreement paper needs 4 signatures. The Notary : Once Agreement is done, come back to Sub-registrar office and make a notary of the agreement. Now your Agreement is legalized. Without notary, your agreement has no value.
Paying Deposit : Always pay the deposit in the form of Demand Draft or Cheque and mention the DD Number / Cheque Number in your rental agreement. This is required in case if any legal issues happens between the landlord and tenant. While paying the deposit get the PAN Number from the tenant. This is required at the time of filling the TAX. Now Government has made it mandatory to quote the PAN Number of landlord while filling the TAX. So remember to collect the PAN Number and mention it in the Agreement copy. Otherwise if the owner gives you a wrong PAN Number then it will be difficult to cross verify. Never pay the amount in the form of direct cash.
Inventory Details: Make sure to list all the accessories and domestic equipment which is installed in the house and mention the same in the rental agreement.

Make sure to mention the state of the house at the time of tenancy. This includes Painting is done or not done. Any damages are there on the wall ?. How many holes are there in the wall. Doors are proper ? Tap leakage is there ?. How is the kitchen furnishing. Is the wooden works are damaged ? or is it aged ? Window glasses are proper ?. Boiler is working or not?. Is it rusted?. How much time it takes to heat the water fully. Fan is working? Bulbs are working ?. Exhaust fan working? etc.
Check the whether electricity bill paid up to date by the owner or previous tenant. If not done, then get it done by the owner before shifting to his house. Otherwise it will be problematic to you once after shifting the house.
En-quire about water availability in the area. Is it a tank water or corporation water. If it is tank water then Maintenance cost will increase. Be aware of that.

Monthly Rent Payment: Make sure to pay the rent on monthly basis to a bank account. Never pay the rent in cash. Because you will end up in no proof.
Any facilities issues happens in the rented house then report it to the landlord. Get it repaired by the landlord.

Inform landlord one month in advance. Make sure S/he visits and perform house check before you leave. Collect advance amount before you leave the house. Never leave the house before advance amount is settled.
